{"id":426,"date":"2020-08-14T16:12:34","date_gmt":"2020-08-14T16:12:34","guid":{"rendered":"http:\/\/iclr.in\/?page_id=426"},"modified":"2021-07-15T05:19:38","modified_gmt":"2021-07-15T05:19:38","slug":"symposium","status":"publish","type":"page","link":"http:\/\/iclr.in\/?page_id=426","title":{"rendered":"Symposium &#038; Panel Discussions"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Panel Discussion on &#8220;Revisiting age-old problems in search of cutting edge solutions in The Banking and Competition sector&#8221; [March 8th 2020]<\/h2>\n\n\n\n<p>On March\n8<sup>th<\/sup>, 2020, the Centre, in conjunction with the Centre For Studies in\nBanking And Finance, organized a symposium on the theme \u201c\u201cRevisiting age-old\nproblems in search of cutting edge solutions in The Banking and Competition\nsector\u201d. The symposium was graced by the presence of several prominent members in\nthe finance and competition sector such as Dr. K.D. Singh, the Joint Director\nCompetition Commission of India, Mr. Ujjwal Mehta, a distinguished member of\nCUTS-CIER in Jaipur as well as Mr. Gautam Chawla, an eminent Counsel placed at\nTrilegal. As the theme suggests, the deliberation primarily focused on\ndissecting and analysing the archaic problems existing in the competition\nsector especially in the backdrop of the Competition (Amendment) Bill, 2020\nwhich proposes significant changes to the existing scenario in the sphere of\ncompetition law and policy. To get the ball rolling, the distinguished speakers\ninitially discussed the Report of the Competition Law Review Committee, which\nprovided various recommendations for amendments to substantive and procedural\nprovisions of the Competition Act, 2000, in order to realign the law with the\nprogressively changing business landscape. The discussion proceeded towards\nscrutinizing the Draft Amendment Bill in order to lay down the pre-existing\nconcerns raised by various stakeholders in the market and the numerous ways in\nwhich the Bill effectively addresses them or in certain scenarios, fails to do\nso. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Panel Discussion on \u201cBanking&nbsp; Sector at the cross-roads of Disruption: Competition Law perspective\u201d [ March 30, 2019] <\/h2>\n\n\n\n<figure class=\"wp-block-image alignwide\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"390\" src=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-1-1024x390.png\" alt=\"\" class=\"wp-image-620\" srcset=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-1-1024x390.png 1024w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-1-300x114.png 300w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-1-768x292.png 768w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-1-1600x609.png 1600w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>On March 30 2019, the Centre with Centre for Studies in&nbsp; Banking and Finance (CSBF) at&nbsp; National Law University, Jodhpur (NLUJ)&nbsp; collectively organized a one-day panel discussion on the theme \u201cBanking&nbsp; Sector at the cross-roads of Disruption: Competition Law perspective\u201d. The esteemed panellists for the discussion included- Dr Geeta Gouri, Economist and Former Member of the Competition Commission of India; Prof. Vijay Kumar Singh, Professor of Law, UPES School of Law, Dehradun and Former Deputy Director (Law), Competition Commission of India; Ms Payal Malik, Adviser and Head, Economics  Division of the Competition Commission of India;  Ms. Soumya Hariharan, Partner, Competition Law Practice at Trilegal, Mumbai; Mr Rudresh Singh, Managing Associate, L&amp;L Partners Law Offices, New Delhi; Mr Dhruv Rajain, Senior Associate, Competition Law Practice at Cyril Amarchand Mangaldas, New Delhi; Mr Nalin Kumar, Senior Manager (Legal), ICICI Bank Ltd and Ms Divya Mohil, Senior Legal Counsel, Clix Capital Services Pvt. Ltd. The Panel Discussion was divided into two sessions with respective panellists. The first panel discussed the topic \u201cCompetition Law in the Banking Sector\u201d, which covered various issues such as \u201cCompetition Scrutiny of Bank Mergers\u201d, \u201cFintech: A Driver of \u2018Competition\u2019 in the Banking Industry\u201d, \u201cdelineation of the relevant market in cases involving the service of providing particular loans\u201d. <\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"390\" src=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-2-1024x390.png\" alt=\"\" class=\"wp-image-619\" srcset=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-2-1024x390.png 1024w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-2-300x114.png 300w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-2-768x292.png 768w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/2019-pic-2-1600x609.png 1600w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>The second panel mostly focused on the \u201cRecent Trends in Competition Law\u201d, which included \u201cA Review of Competition Jurisprudence in 2018\u201d and other issues such as \u201cBig data and competition law\u201d, \u201cStructural v. Behavioural Remedies\u201d. The panel also discussed \u201cCCI approval timelines in IBC cases\u201d. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Panel Discussion on \u201cEmerging Issues in Competition Law\u201d [ September 16th-17th, 2017] <\/h2>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"390\" src=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/Untitled-design-1024x390.png\" alt=\"\" class=\"wp-image-617\" srcset=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/Untitled-design-1024x390.png 1024w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/Untitled-design-300x114.png 300w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/Untitled-design-768x292.png 768w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/Untitled-design-1600x609.png 1600w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>A panel discussion was organised by the Centre on September 16 &amp; 17, 2017, on the theme- \u201cEmerging Issues in Competition Law\u201d. The panel constituted an array of guest speakers who are all renowned experts in the field of competition law. These included Ms Nisha Kaur Uberoi, Partner and Practise head, Trilegal; Mr Anshuman Sakle, Partner, Cyril Amarchand Mangaldas; Ms Soumya Hariharan, Counsel, Trilegal; Shashank Sharma, Senior Associate, AZB and Partners and Mr Anand Venkataramani, Associate, Shardul Amarchand Mangaldas. The discussion was spread over three segments dealing with the themes of \u201cEmerging issues on dominance in competition law\u201d, \u201cOther contemporary issues of competition law in India\u201d, and \u201cCareers in Competition law\u201d. The panel in a two-day discussion, discussed various topics, ranging from \u201cBig Data and Competition Law\u201d, \u201cCollective dominance\u201d to \u201cThe scope of settlement in competition law\u201d. The panel discussed the implication of the excessive consumer data held by the enterprises and how it is helping companies attain the dominant position and affect competition. Further, it went on to discuss the concept of collective dominance and the need to introduce such a concept in the regime citing numerous examples.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" loading=\"lazy\" width=\"1024\" height=\"390\" src=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/photo-2-1-1024x390.png\" alt=\"\" class=\"wp-image-618\" srcset=\"http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/photo-2-1-1024x390.png 1024w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/photo-2-1-300x114.png 300w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/photo-2-1-768x292.png 768w, http:\/\/iclr.in\/wp-content\/uploads\/2020\/08\/photo-2-1-1600x609.png 1600w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure>\n\n\n\n<p>On its second day, the panel proceeded towards discussing various \u201cjurisdiction tussles\u201d between regulators, such as that between Telecom Regulatory and the Competition Commission of India. It went on to discuss \u201cthe competence of NCLAT in taking over the role of COMPAT\u201d, the rationale behind it and the road ahead. The discussion proceeded towards identifying the \u201cscope of settlement in competition law disputes\u201d. Even though such a mechanism provides flexibility to the parties and saves substantial litigation cost, it is currently absent in the Indian regime. Keeping in mind the audience, a majority of which were law students, the panel discussed various \u201ccareers in competition law\u201d and the various academic qualifications required to enter the field.
